The bigger issue is that the bankruptcy reform act made it virtually impossible to discharge these debts in bankruptcy.

You could raise colorable disputes due to the bankruptcy non-dischargability driving tuition rates to increase faster than inflation even as costs did not. Defendants can settle cases even if they're meritless so the law shouldn't distinguish between blanket forgiveness and a dummy plaintiff bringing a class action that the admin settles immediately. It's not coherent that Congress can stop one but not the other.

Not sure that creates a tolerable* dispute despite the argument. You signed the paperwork, borrowed the money, and presumably enrolled in school.

Yet, courts are amenable to reining in executive power depending upon what side of the bed they got up on.

I think I'm with Mn here. Much like PA thinks all people who roll stop signs should be ticketed, I think all former or current presidents who mishandle docs should be permanently barred from office and thrown in jail. Done.
