The judge has granted Durham's request for in camera review of 38 Fusion GPS documents/emails that Fusion GPS portrayed as protected by attorney/client privilege. Fusion GPS also argued that they have asserted privilege on over 1500 documents/emails to Durham.
The prosecution left the door open regarding questioning the validity of the attorney/client privilege assertion in the remaining 1500 documents/emails if the judge agrees that the 38, upon review, are not protected by privilege. When questioned by the judge, the prosecution replied "not in this case".
