The judge has granted Durham's request for in camera review of 38 Fusion GPS documents/emails that Fusion GPS portrayed as protected by attorney/client privilege. Fusion GPS also argued that they have asserted privilege on over 1500 documents/emails to Durham.

The prosecution left the door open regarding questioning the validity of the attorney/client privilege assertion in the remaining 1500 documents/emails if the judge agrees that the 38, upon review, are not protected by privilege. When questioned by the judge, the prosecution replied "not in this case".

And someone who sat in on meetings will be called.

Lots of options for Judge Cooper when he reviews the privilege claims.  He may rule that some or all of the Fusion emails are not privileged, but also prevent them from coming into the trial as evidence because they are prejudicial, irrelevant, or hearsay to the charge against Sussmann.

Cooper may also rule Durham violated local rules in his attempt to obtain the emails and so cannot use them at trial.

There’s also the chance that some of the documents disprove Durham’s conspiracy theories.
