Weiss cannot litigate charges Biden in DC or Cal without being special counsel. Someone else would have to do that.
Which makes the decision to name him special counsel understandable, and, ironically, in line with the requests of certain GOP congressman over the past year.
Re March 1 ABC article and Garland appearing before Senate Judiciary ..
"Garland made clear that Weiss has been told he has "full authority" to make any charging decisions stemming from the investigation,
even if that would involve bringing a case in a district outside of Delaware."https://abcnews.go.com/Politics/senate-panel-expected-grill-garland-trump-biden-special/story?id=97549404I guess not, eh ?
""If my assumption is correct, I want to make clear that, as the Attorney General has stated,
I have been granted ultimate authority over this matter, including responsibility for deciding where, when, and whether to file charges and for making decisions necessary to preserve the integrity of the prosecution, consistent with federal law, the Principles of Federal Prosecution, and Departmental regulations," he wrote."
Except for that tricky part at the end that doesn't exactly say that I don't have venue in Delaware but that's what it means. The 1st part sure sounds good tho. Lol.
