Some legal "experts" were undoubtedly behind the decision to bootstrap the expired misdemeanors to intent to commit a "crime".
The FEC wouldn't pursue an election violation and yet a former FEC commissioner isn't allowed to rebut the prosecution position for the defense ?

How does that matter? Sounds like the judge ruled that the jury is to make that determination not an expert. Sounds like the judge is thinking that if the underlying charge was a theft in another jurisdiction that was not pursued, you would not have a prosecutor provide expert testimony. The jury would be instructed and decide if the theft occured.

It sounds like Costello was supposed to keep tabs on Cohen to make sure he never flipped. Doesn't look like Costello did a very good job.
Costello was trying to advise and help Cohen pre-indictment. Costello says that Cohen said he had nothing on Trump that Costello could use in a cooperation agreement with the prosecution to avoid indictment.

I didn't sit through all the testimony. We shall see what happens. I just read that Cohen admitted lying to the Costello at the time. Doesn't sound like there was really much to cover with Costello if that was the case.

How does that matter? Sounds like the judge ruled that the jury is to make that determination not an expert. Sounds like the judge is thinking that if the underlying charge was a theft in another jurisdiction that was not pursued, you would not have a prosecutor provide expert testimony. The jury would be instructed and decide if the theft occured.
The case is precedent setting and you're going with the jury getting to decide whether federal election law, if that's the "crime", was violated without the defense being allowed to present a defense ?

The prosecutor under Cyrus Vance who was tasked with the SDNY case against Trump, which was dropped, recently pleaded the 5th regarding the case.

They can present fact witnesses. There was been testimony about the reason they did what they did and it was unrelated to the election. The FEC guy has no persoanl knowledge of the underlying facts and was to provide expert testimony on whether a violation occurred. Judge ruled that is for the jury to decide.

I think the witness was to testify on federal election law, not whether a "crime" was committed.
The FEC did decline to pursue. The reasoning may be informative.
