"Arrest" defined -- Restraint allowed. An arrest is an actual restraint of the person arrested or submission to custody. The person shall not be subjected to any more restraint than is necessary for his arrest and detention.

Utah Code § 77-7-3
A private person may arrest another:

(1) For a public offense committed or attempted in his presence; or
(2) When a felony has been committed and he has reasonable cause to believe the person arrested has committed it.

Agree. If you're going in, don't be a puss about it - like this cycling twat.

High marks for the kid for staying cool. I'd don't know that 22-year-old me would have had that kind of restraint. Also, he was cited with no evidence. Nice work, cop. Thankfully the prosecutor threw it out.

he was driving a car. You have to be pretty egregious to ever get prosecuted for anything you do in a car. Except speeding on Illinois 47 at 2 mile over the limit - that's a ticket you're gonna pay
