And the process is being argued in court. SCOTUS essentially told the judge that her powers end with a request of a facilitation of release, she can not order an "effectuation" of release and that she has no jurisdiction over foreign affairs.

I disagree but it is moot. Garcia was denied due process. I don't think anyone disagrees with that. The question is what can be done now?  is it oops, too fucken late?

The other question is what is due process if a person is legally present with a status of withholding of removal? In the event ICE finds a third country willing to accept them, can they just act unilaterally? Or is a new hearing and a new order of removal required?

Any old orders of removal would no longer be valid once withholding of removal is granted. First, they would have to get his withholding of removal revoked. Then  seek a new order of deportation.

It sounds like he was to be deported. Just not to El Salvador.

His status was "Withholding of Removal" since 2019. He checked in with ICE annually.
