Only a judge, not the President, should decide if US designated foreign terrorists are allowed to stay in the country, or be returned from international airspace to the country.
It's especially fitting that the judge be the FISA Court judge who gave probation to the FBI lawyer who misled the FISA Court in the Carter Page FISA application.
It's especially fitting that the judge be the judge who authorized 2017 subpoenas on 2 Congressmen, Jason Foster and the current FBI Director, Kash Patel in Russiagate.
Foster is still trying to unseal the subpoenas.

Disrupting supply has been the strategy by both sides for pretty much forever until the torrent that flowed across the past several years. Not just on border crossings, but drugs, etc. Obviously with mixed results, but I don’t think an open border with no ramifications for entering is the answer either, just like it wasn’t the answer for Portland to legalize hard drugs.

The GOP wasn't particularly concerned about disrupting the supply Richard Sackler was providing

Obviously not, but it was a pointless, stupid stunt to appease who, exactly?

Deporting gang members here illegally is wildly popular, even if an obscure policy was used and mid-air court orders were ignored. Perhaps especially so, after being told for year there was nothing Joe could do.

Only the most deranged of the TDS crowd could oppose it, and only on the grounds of “due process” and “obeying court orders.” It’s the wrong battle for Democrats to fight right now.

He’s said for months he planned to use it to get these assholes out of here without having it tied up in the bureaucracy and racking up expenses indefinitely. I don’t see the problem.

He could simply use expedited removal. Why is it important for him to exercise war powers? You don't find that significant?

Not really, but I am also not spending time parsing every detail of what Trump does trying to find reason to get mad or offended. To me it appears that the EO declaring these violent/gang illegals as essentially invaders then invoking the war powers grants more sweeping authority and fewer potential roadblocks to executing the roundups.

Will I be upset if he uses this to round up maids and roofers who aren’t causing any problems? Yes. But maybe we should let it play out a little before we play the “it’s a constitutional crisis” card. These people never should have been here to begin with, and I really don’t give a shit what strings the the admin has to pull to get them out of here.

More red meat for the MAGAs.  Apparently using current law is not giving Trump the flashy visuals of mass deportations he was expecting.  Trump’s initial immigration actions have been largely underwhelming in terms of the number of deportations he continually claimed would happen during the campaign.

They just sent all of the migrants that were being held at Guantanamo (which was only about 40 people) back to the US because Trump's DOJ was going to have to appear in court in the next week or so to face a lawsuit over the detentions because only a few of the migrants being detained remotely fit the description that Trump claimed (“dangerous criminals”). 

It's true that nobody is losing sleep over gang members being deported, but Trump sold a false narrative that he can't deliver on and is now desperately casting about for ways he can use to convince his cult that the false narrative might still be true.  Sadly, the way he's going to do that is treat migrants who have not committed a crime and have no criminal record like violent criminals.

While I am sure you desperately want this to be true, I don’t think it makes much sense. As he does, he bloviated about mass deportations beyond just criminal elements, but also hinted at primarily focusing on criminals. That’s what they’ve done to this point, and the base aka “cult” seems to be ecstatic about it. Don’t think he needs to go after regular folks just to appease the relatively small radical element that wants them all gone at the risk of alienating a bunch of the others that wanted exactly what we’ve been getting.

The Trump gang knew they couldn't remove “11 million people”.  They have nowhere near the ICE staff or facilities. So the plan was to launch a huge, loud, PR blitz with lots of tough talk and video of planes taking a few dozen people away so they could throw red meat to the MAGA base and fool them into thinking lots was being done. 

Trump spent his first weeks in office emphasizing a mass deportation campaign aimed at criminals who are in the country illegally.  That’s fine, but it looks like Trump isn't content with targeting undocumented immigrants.  His administration is now testing its power to deport any non-citizen it feels like without just cause or due process.

The low key most amusing part is Riley Gaines, of "I lost to a man in my swim race" fame - rallying behind Trump because transgender and her husband who is a british citizen being deported
