No. That damn 250 year old piece of paper gets in the way again. Something about a jury, I believe.
Same piece of paper had something about free speech. I am allowed to disagree with jury verdicts. A lot of people think OJ was guilty. They called it jury nullification.
During the interview with TC, KR admitted pointing his gun at several people. He said he did not shoot them only because they backed off.
I think the prosecutor charged wrong. No way it was 1st degree.
"Mitigating circumstances. The following are affirmative defenses to prosecution under this section which mitigate the offense to 2nd-degree intentional homicide under s. 940.05:
...
(b) Unnecessary defensive force. Death was caused because the actor believed he or she or another was in imminent danger of death or great bodily harm and that the force used was necessary to defend the endangered person, if either belief was unreasonable."
If he is gonna charge, should be 2nd degree. That said, he was a 17 year old kid in way over his head. In my mind, that mitigates. This probably should have been left in juvie ...
As it is, it still sent a message that anyone who feels threatened can escalate to deadly force and call it self defense. KR said it. Self defense was on trial. Or how we define it.
