He declared the gangs to be terrorist organizations operating on US soil, so it seems pretty cut and dried that the act could be invoked. Unless you have TDS so bad that swiftly and decisively deporting criminal scum upsets you.

Why not just line them against a wall and execute them? Unless even Republicans still put the rule of law above swiftly and decisively executing criminal scum? So instead pay EL Salvador to deal with them?
My understanding is that act can be invoked in very specific situations -- against citizens of foreign nations that have either declared war on or invaded the United States.
This is the same act that was used to detain Germans, Italians, and especially Japanese during WWII

I am pretty sure that is not even what he did. I think he claimed that the Venezuelan gang is sort of like a nation that invaded the US. So he is sending them to El Salvador to be detained.
Basically, it's an excuse to round up perceived undesirables without an ounce of due process.
So much for strict construction.
