This decision allows local law enforcement to focus their resources on keeping people safe.”

"In the decision issued today, the SJC found that “Massachusetts law provides no authority for Massachusetts court officers to arrest and hold an individual solely on the basis of a Federal civil immigration detainer, beyond the time that the individual would otherwise be entitled to be released from State custody.”

Local law enforcement not authorized to arrest because of an ICE detainer is not the same as local law enforcement arresting and detaining a threat to the community.

I was responding to your earlier post that suggested lCE detainers were being "ignored" in the state.  Not true.  Local law officials pointed out the loophole in the state law.   Legislation has been introduced that would provide a 30-day buffer like other states have.

The ICE detainers weren’t “ignored”.  Local law enforcement does not have authority to hold someone beyond their entitled release date if ICE has a detainer on them.  It’s a loophole in the Massachusetts state law.  Legislation has been introduced to close the loophole by allowing ICE detainers to be honored for 36 hours. 
For a ridiculously low amount of money, a judge may allow you too to be able to bail a pedo with an ICE detainer out of jail before ICE has the opportunity to detain him.
Free the pedos.

ICE is typically notified, but it doesn't have the staff to respond quickly in many instances.  Legislation has been introduced that would give local law enforcement the power to hold undocumented immigrants that allegedly commit crimes for up to 36 hours beyond their standard release from custody if ICE has a detainer request on them.  The bill has the support of local sheriff departments.
